JUSTICE RAKESH KUMAR ORAL ORDER 12-07-2016 Heard Sri Arun Kumar Arun, learned counsel for the petitioner. None appeared on behalf of the State. The petitioner, who is in custody in Maranchi P.S. Case no.27/2015 registered for the offence under Section 302/34 of the Indian Penal Code and Section-27 of the Arms Act, has prayed for grant of bail.

Learned counsel for the petitioner, by way of referring to F.I.R. as well as paragraph-10 of the petition, submits that of course in the F.I.R. there is allegation that number of persons have fired, but the injury does not corroborate that the petitioner caused any injury to the deceased. Accordingly, he has made a prayer for grant of bail.

Besides hearing learned counsel for the petitioner, I

Patna High Court Cr.Misc. No.26740 of 2016 (2) dt.12-07-2016 2/2 have perused the F.I.R. On perusal of the F.I.R., it is evident that there is specific allegation against the petitioner that he had also fired, which caused death to the husband of the informant. I do not find any ground to extend the privilege of bail. The petition stands dismissed.
