JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-09-2019 This application, for grant of anticipatory bail, arises out of Shambhuganj P.S. Case No. 46/2019, disclosing offences under Section 376 of the Indian Penal Code and Section 4 of POCSO Act.

Allegation against the petitioner is of committing rape upon the informant.

Submission of learned counsel for the petitioner is that there was love affair between the parties and now they have also compromised the matter and after marriage, the informant is living with the petitioner .

Heard learned A.P.P. also.

In this case earlier notice was issued to opposite party no. 2 and it appears that the Vakalatnama has also been filed but non has appeared on her behalf.

No.35984 of 2019(5) dt.13-09-2019 2/2 Having heard both sides, in such view of the matter, this application is disposed of with direction to the petitioner to surrender in the court below within a period of two weeks from the date of receipt of this order along with the informant as it has been submitted of learned counsel for the petitioner that now the matter has been compromised and informant is living with the petitioner and the court below shall enquire about the compromise being reached between the parties and on verification, if the submission is found true, the court below shall release the petitioner on bail otherwise, the petitioner has to surrender and pray for regular bail.
