JUSTICE ANIL KUMAR SINHA ORAL ORDER 25-03-2022 Heard Ms Vaishnavi Singh, learned counsel for the petitioner and Mr. Dilip Kumar No. 1, Additional Public Prosecutor for the State through video conferencing. Petitioner seeks regular bail in connection with Sasaram Town PS Case No. 213/2021 registered for the offence punishable under Sections 25(1-b)a, 26/35 of the Arms Act. The police on the basis of secret information raided the house of one Manoj Pandey and recovered one live cartridge from possession of the petitioner and from possession of other accused persons fire-arms, cartridges etc, were recovered. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he has been implicated in this case by the police with oblique motive and at the time of search and seizure no procedure prescribed under

Patna High Court CR. MISC. No.49954 of 2021(2) dt.25-03-2022 2/2 Section 100 CrPC was followed. She further submits that the petitioner is in custody since 22.03.2021. Charge-sheet in the matter has already been submitted.

Having regards to the submissions made by the parties and taking into consideration the material on record and the fact that the petitioner having no criminal antecedent is in custody since 22.03.2021 and the charge-sheet has been submitted in the matter, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, SIKESH RANJAN TIWARI @ JHUNA be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram Town PS Case No. 213/2021.
