The petitioners apprehend their arrest in connection with Bodh-Gaya P.S. Case No. 254 of 2014 (G.R. No. 3763 of 2014) registered under Sections 411/34 of the I.P.C. pending in the Court of Chief Judicial Magistrate, Gaya.
The Police on receiving the information about keeping the theft motorcycle by petitioner Satendra Yadav and also selling the theft motorcycle earlier to petitioner Ram Pravesh Yadav, co-accused Mahendra Yadav and others, reached at his
Patna High Court Cr.Misc. No.50138 of 2014 (3) dt.24-06-2015 house, while he managed to escape. On search, the Police Party recovered the two stolen Hero Honda motorcycle from the door of the petitioner Satendra Yadav and also one stolen motorcycle from the house of the petitioner Ram Pravesh Kumar and one motorcycle from the house of Mahendra Kumar.
Learned counsel appearing on behalf of the petitioners submits that the alleged recovered motorcycles were kept by co-accused at the house of the petitioners. Having considered the facts and circumstances of the case, I am not inclined to allow the prayer of the petitioners for anticipatory bail. Accordingly, this application stands rejected. However, petitioners are directed to surrender before the trial Court and pray for regular bail which shall be decided on its own merit without being prejudiced by this order.
