JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 47(A) of the Bihar Excise Amendment Act, 2016.

Sixty liters toddy is said to have been recovered from the house of the petitioner but submissions of the petitioner is that even if aforesaid recovery assumed to be true, then also the said recovery was made from the joint house. It is submitted that the petitioner does not have any criminal antecedents and he is languishing in jail custody since 20.4.2016.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named,

Patna High Court Cr.Misc. No.29874 of 2016 (2) dt.28-07-2016 2/2 be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned District and Sessions Judge, Khagaria, in connection with Excise Case No. 161 C3 of 2016.
