JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 395 of the Indian Penal Code. The name of petitioner came in this case on the basis of information given by spy of the police, which is evident from perusal of para-15 of the main case diary. Later on, the house of the petitioner was searched and some clothes as well as other articles were recovered from his house.

Submission on behalf of the petitioner is that the recovered clothes are of daily uses and as a matter of fact, the seized articles were not looted property. It is further submitted that petitioner does not have any criminal antecedent and the only fault

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in connection with Maharajganj P.S. Case No. 25 of 2004.
