The Petitioner seeks bail in Bagaha P.S. Case No. 183 of 1991 instituted for the offence under Section(s) 364, 302, 201, 120B of the Indian Penal Code.
This is a case of misuse of privilege of bail. The petitioner was arrested on the basis of warrant of arrest issued by the Court below and he is in custody since 08.07.2015. It has been submitted on behalf of the petitioner that petitioner will not commit such latches again in future. Keeping in view the period spent by the petitioner in the custody, this Court feels that petitioner has sufficiently been punished for the latches, In the circumstance,
Patna High Court Cr.Misc. No.13229 of 2017 (3) dt.20-04-2017 2/2 prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of 2nd Additional Sessions Judge, Bagaha, West Champaran in connection with Sessions Trial No. 220 of 2001, arising out of Bagaha P.S. Case No. 183 of 1991, subject to the conditions that both the bailors shall be the close relative of the petitioner.
The petitioner will remain present before the Trial Court on each and every date and two subsequent defaults will amount to cancellation of bail of the petitioner. (Sanjay Priya, J) Shageer/- U T
