JUSTICE SANJAY PRIYA ORAL ORDER 18-04-2017 Heard learned counsel for the petitioners and the State. Petitioners seek bail in Mirganj P.S. Case No. 19 of 2017 instituted for the offence under Sections-419, 420, 467, 468, 471 of the Indian Penal Code.
It is alleged that the informant had gone to withdraw money by ATM of his brother and two unknown boys in the meantime, entered in the ATM and one of the boy put his ATM card and thereafter, on the next day, the informant found that Rs. 10,000/ has been debited from the account of the informant. In paragraph-3, it has been mentioned that petitioners have no criminal antecedent. No money has been recovered from possession of the petitioners. Petitioners have been apprehended
Patna High Court Cr.Misc. No.12419 of 2017 (4) dt.18-04-2017 2/2 merely on suspicion after disclosure of their name by a sweet shop owner, namely Chhotelal.
Considering the above facts and circumstances, the prayer for bail allowed and the petitioners named above, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Mirganj P.S. Case No. 19 of 2017 to the satisfaction of learned Chief Judicial Magistrate, Gopalganj subject to condition that both the bailors should be close relatives of the petitioners.
