JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 16-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

There happens to be an allegation levelled against the petitioner and others whose suspicious activities were perceived by the police as they sped away their motorcycle seeing the police. Three persons managed to escape while petitioner along with motorcycle was apprehended.

Contention on behalf of petitioner is that motorcycle belongs to his cousin brother and before the learned lower Court also he had pleaded likeso. It has further been submitted that petitioner has got criminal antecedent, but is under custody since 30.03.2016.

On the other hand, learned Additional Public

Patna High Court Cr.Misc. No.33280 of 2016 (02) dt.16-08-2016 Prosecutor opposed the prayer.

In case, petitioner substantiates before the learned lower Court by cogent evidence that motorcycle belonged to his cousin brother, then in that event, the learned lower Court will release the petitioner on bail to its own satisfaction. With the aforesaid direction, instant petition is disposed of.
