JUSTICE SANJAY PRIYA ORAL ORDER 2/ 22-03-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The Petitioner seeks bail in Nabinagar P.S. Case No.145 of 2016 instituted for the offence under Section(s) 409, 420 Indian Penal Code.

As per allegation, the petitioner being Headmaster of Primary School, Basaha, did not complete construction work and as per measurement total `9,30,264/- was realizable from the petitioner, which is apparent from page 17 enclosed with the written report.

Counsel for the petitioner has pointed out Annexure2 issued by the District Programme Officer, dated, 20.01.2017, wherein, it has been stated that entire dues of the amount i.e. `9,79,200/- has been adjusted against this petitioner.

Patna High Court Cr.Misc. No.11572 of 2017 (2) dt.22-03-2017 2/2 In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of `10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, in connection with Nabinagar P.S. Case No.145 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
