The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 7 of the Essential Commodities Act.
It is alleged that from the P.D.S. dealership of the petitioner 24 quintals 26 K.gs wheat and 36 quintals 54 K.gs rice were found short.
It is submitted by the learned counsel for the petitioner that inspection was made on 24.08.2014, whereas the First Information Report was registered on 29.08.2014 and there is no explanation for such delay. The inspection was done in absence of the petitioner without any intimation. Hence proper verification of the stock was not made and the license of the petitioner's dealership has been suspended. Patna High Court Cr.Misc. No.13607 of 2015 (3) dt.18-05-2015 effect has been made in para-21 of the petition. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Shankarpur P.S. Case No. 102 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
