JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 18-04-2017 Heard learned counsel for the appellant as well as learned Special Public Prosecutor.

Deceased, who are engaged in toddy business, was shot dead by an unknown criminal on account thereof, on the fardbayan of Mina Devi, his wife, instant case has been registered against unknown.

From perusal of the case diary, it is evident that neither there happens to be direct evidence nor circumstantial evidence, save and except suspicion shown against him including others being an accused in Teghra P. S. Case No.394 of 2014 registered on account of murder of Pankaj Singh and further, they were forbidding one Antu Kumar @ Anand @ Lakra and his family members not to depose.

Patna High Court CR. APP (SJ) No.347 of 2017 (04) dt.18-04-2017 Accordingly, setting aside the order dated 29.11.2016 passed by the Special Judge, S.C./S.T., Begusarai in Teghra P. S. Case No.372 of 2015, appellant, Bijay Singh @ Vijay Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, S.C./ S.T. Act, Begusarai in connection with Teghra P. S. Case No.372 of 2015.

Consequent thereupon, appeal is allowed.
