19-08-2016 Heard Sri Umesh Chandra Verma, learned counsel for the petitioner and Sri Nityanand Tiwary, learned Addl. Public Prosecutor.
The petitioner, who is in custody since 08-05-2016 in Raxaul P.S. Case No. 78 of 2016 registered for offence under Sections 47(A), 54, 53(b) of the Bihar Excise (Amendment) Act, 2016, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that on an allegation of recovery of about five litres of Nepali country-made liquor, the petitioner has been arrested, whereas, Sri Tiwary, learned Addl. Public Prosecutor opposing the prayer of bail submits that when the petitioner was arrested, he had consumed liquor and he was carrying liquor.

No.32321 of 2016 (2) dt.19-08-2016 2/2 Be that as it may, in view of nature of accusation and period of custody, let the petitioner namely Santosh Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Raxaul, Motihari, East Champaran in connection with Raxaul P.S. Case No. 78 of 2016.
