JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-07-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 307, 353, 332, 337, 338 and 504 of the Indian Penal Code. The prosecution case is that the informant being the Chaukidar found 60-70 buffaloes in the orchard of Nasir Khan. On enquiry it was found animals were brought by the petitioners. The informant informed to Kangali P.S. On information, the S.H.O. of Kangali P.S. and Balthar P.S. reached on the spot when petitioners attacked the police force pelted stones and obstructed the police to discharge their duties.

No.23918 of 2015 (2) dt.09-07-2015 2/2 It is submitted by learned counsel for the petitioners that the petitioner no.1 Yahiya Khan has got licence of cattle pound and under a valid purchase, the animals were being carried and the police maliciously tried to seize the animals when protest was made but no injury was caused to anyone. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., West Champaran at Bettiah in connection with Kangali P.S. Case No. 15 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
