JUSTICE SUDHIR SINGH ORAL ORDER 19-10-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 302/34, 324, 326 and 307 of the I.P.C. and Section 27 of the Arms Act.
Allegation against the petitioner is that he along with other accused persons fired shots at the informant and others, as a result of which one constable Santosh Singh died. It has been submitted on behalf of the petitioner that the petitioner is in custody since 22.3.2016 and the charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. Subsequently in course of investigation his name has appeared. Patna High Court Cr.Misc. No.34702 of 2016 (3) dt.19-10-2016 2/2 put on Test Identification Parade. The other co-accused has been granted bail vide Cr.Misc.No.29935 of 2016, Cr.Misc.No.41651 of 2015 and Cr.Misc.No.14837 of 2015.
On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Lakhisarai in connection with Rail Jamalpur P.S. case No.02 of 2015.
