JUSTICE SANJAY PRIYA ORAL ORDER 12-04-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Rajpur P.S. Case No. 110 of 2016 instituted for the offence under Sections 394/411 of the Indian Penal Code.

As per allegation, four persons hired the vehicle of the informant on rent near Mahavir temple on Chausa Bhabhua Road and on the way, those four persons snatched the vehicle of informant on the point of pistol. The driver of the vehicle raised hulla. The informant was informed by one person that his Scorpio had met with an accident upon which, informant went to that place and found four persons running away. The police personnel arrived there. The aforesaid persons were chased and arrested among whom, one of them was the petitioner. It is alleged that

Patna High Court Cr.Misc. No.11106 of 2017 (3) dt.12-04-2017 2/2 one loaded pistol has been recovered from possession of the petitioner. The seizure list is enclosed with written report wherein there is no mention of recovery of loaded pistol from possession of the petitioner. It is mentioned in seizure list that one Scorpio vehicle was recovered from possession of petitioner. It has been submitted on behalf of the petitioner that he is in custody since 24.6.2016.

In such circumstances, keeping in view the period spent by the petitioner in custody, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge V, Buxar, in connection with Sessions Trial No. 285 of 2016 arising out of Rajpur P.S. Case No. 110 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
