2. The petitioner has preferred this application for grant of regular bail in connection with Gogari P.S. Case No. 432 of 2023 dated 15.11.2023 registered for the offences punishable under sections 341, 427, 385, 506 and 34 of the Indian Penal Code and under Section 27 of the Arms Act.

3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have forcefully ploughed the field of the informant and when the informant objected, they threatened him and demanded Rs. 2 lakh as extortion from the informant. The accused persons also fired on the informant with illegal arms.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.47528 of 2024(2) dt.29-07-2024 2/2 that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the possession of the petitioner. Learned counsel for the petitioner has submitted that there is no specific allegation against the petitioner rather the allegation is general and omnibus in nature. There is land dispute between both the parties. The petitioner has three antecedents in which he is on bail in all cases as stated in para 3 of the bail petition. The petitioner is in custody since 16.11.2023.

5. Learned A.P.P. for the State has opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Gogari P.S. Case No. 432 of 2023.

7. The application stands allowed.
