JUSTICE SUDHIR SINGH ORAL ORDER 12-07-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 341,323, 324, 325, 307 and 379 of the Indian Penal Code.

Allegation of assault and taking away a golden chain from the informant is alleged against the petitioners. It is submitted on behalf of the petitioners that they have got no criminal antecedent. They have falsely been implicated in the present case. No specific injury has been attributed against the petitioners. General and omnibus allegation has been made. As per doctor's opinion, injury received by Jyoti Kumar is grievous in nature and injury sustained by Binod Yadav is said to be simple in nature.

On behalf of the State, it is submitted that petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each

Patna High Court Cr.Misc. No.27305 of 2016 (3) dt.12-07-2016 2/2 with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar, in connection with Buxar (Industrial) P.S. Case no. 68 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
