JUSTICE SUDHIR SINGH ORAL ORDER 16-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 413, 414, 419, 420, 467, 468 and 120B of the Indian Penal Code.

Allegation against the petitioner is that the truck loaded with stone chips, which he was driving, is a stolen one. It has been submitted on behalf of the petitioner that petitioner has got no criminal antecedent. It is further submitted that petitioner is the driver of the truck in question whose papers are said to be forged documents. The said truck belonged in the name of one Md. Aslam Khan. The petitioner has got nothing to do with the ownership of the truck.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts, let the above named petitioner, in the event of arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing

Patna High Court Cr.Misc. No.23950 of 2015 (3) dt.16-09-2015 2 / 2 bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of Sri Mukesh Kumar , Judicial Magistrate, Ist Class, Bhagalpur, in connection with Ishipur (Barahat) P.S. Case no. 30 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
