The petitioner, who is in custody since 18.04.2016 in connection with Kalyanpur P.S. Case no.48 of 2016 registered for the offence under Section 414 of the Indian Penal Code, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that on false allegation, the petitioner was made accused showing recovery of two motorcycles. By way of referring to F.I.R., he submits that in the F.I.R. itself, the informant has raised only doubt regarding the motorcycles. He submits that it was not a case that motorcycles were stolen, which were recovered from the

Patna High Court Cr.Misc. No.26743 of 2016 (2) dt.12-07-2016 2/2 possession of the petitioner. It was submitted that the petitioner is having clean antecedent. This fact has also been mentioned in paragraph-3 of the petition.

Keeping in view the nature of accusation as well as clean antecedent, let the petitioner, namely, Amarjit Kumar @ Amarjit Sahni be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur in connection with Kalyanpur P.S. Case no.48 of 2016.
