The petitioners, already in custody, seek bail in connection with Simultalla P.S.Case No. 35 of 2015 registered under Sections 302/34 of the Indian penal Code. Allegation in brief is that when the husband of the informant did not return back in the evening, she started searching and found his dead body near a pond and raised suspicion that Naresh Gope once had threatened along with these petitioners to eliminate him.

Submission is that there is no eye witness in this case and merely on the basis of suspicion, these petitioners have been falsely implicated and there is also no allegation of any

Having considered the aforesaid facts and circumstances, the petitioners, namely, Hasua Mian and Charka Mian, are directed to be released on bail upon furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in connection with Simultalla P.S.
