The petitioner seeks bail in connection with Government Official Case No. 125 of 2020, instituted for offences under Sections 30(a) of the Bihar Prohibition and Excise Act, 2018.

It appears that 560 litres of liquor was recovered from a vehicle in which the petitioner was also travelling.

The learned counsel for the petitioner has

Patna High Court CR. MISC. No.36751 of 2020(2) dt.01-02-2021 2/2 submitted that he was returning from his uncle's house and had taken a lift in the said vehicle. Thus, for all practical purposes, he was a gratuitous passenger in the vehicle from where recovery has been made.

The petitioner is in custody since 24.07.2020 and does not have any criminal antecedents.

Considering the afore-stated facts, the petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge II - cum - Special Judge, Nawada, in connection with Government Official Case No. 125 of 2020.

The petition stands allowed.
