JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with G.B. Nagar P.S. Case No. 142 of 2018 registered for the offences punishable under Sections 341, 323 and 498A/34 of the Indian Penal Code.

Prosecution story is that accused persons assaulted the informant by sprinkling kerosene oil on her they tried to burn her and petitioner being husband of the informant is not named in the FIR and later on his name transpired in supervision note. Submission of learned counsel for the petitioner is that earlier the informant has filed a case under Section 498A IPC against the petitioner in which he has been granted bail and thereafter the present case has been filed against the family members and no specific allegation has been attributed against

Heard learned APP and learned counsel for the informant, who has submitted that petitioner is not appearing in this case and he is not taking care of the informant and her daughter.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan, in connection with G.B. Nagar P.S. Case No. 142 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that if any maintenance or any other case is filed by the informant, petitioner has to appear and co-operate in disposal of the same.
