JUSTICE GOPAL PRASAD ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date: 19-01-2015 This writ petition is filed in public interest challenging a notification dated 3.12.2012, stated to have been published by the Punjab Technical University, Kapurthala, the 2nd respondent herein. The grievance of the petitioner is that several courses which are not recognized by competent authority are sought to be run by establishing distant education classes in the State of Bihar. Heard Shri Dinesh Kumar Khoorpiwala, learned counsel for the petitioner, and Shri Deepak Kumar, learned counsel for the respondents.

We find several defects in the writ petition. Firstly, the petitioner is a minor (though she may have become a major during the pendency of the writ petition). A minor cannot be permitted to file a writ petition, in public interest. Secondly, the grievance is only against a notification dated 3.12.2012 and the cause became

Patna High Court CWJC No.2240 of 2013 dt.19-01-2015 3/3 infructuous on account of lapse of time. Thirdly, the University against which the petitioner seeks relief, is situated in the State of Punjab and almost all the respondents reside beyond the limits of territorial jurisdiction of this Court.
