JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-07-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Sections-304(B), 201/34 of the Indian Penal Code. Petitioners happen to be parents-in-law of the deceased and according to prosecution case itself, the marriage of the deceased had taken place five years ago and after marriage, she was residing at her matrimonial home.

Although the informant claims that after marriage of the deceased, her in-laws were demanding motorcycle and cash in dowry but the informant has, nowhere, stated in his written report that the deceased was subjected to cruelty due to above-said illegal

Patna High Court Cr.Misc. No.27705 of 2016 (3) dt.18-07-2016 2/2 demand. Moreover the informant spent her married life at her matrimonial home for near about 5 years and at the time of her death, she was carrying pregnancy.

Submission on behalf of petitioners is that the deceased got some complication due to her pregnancy and subsequently, she died and after that, proper information regarding the death of the deceased was given to the informant who came and participated in cremation of the deceased but subsequently, the informant lodged the present case with ulterior motive.

Considering the above-said facts and circumstances of the case as well as submission of the parties and also taking note of this fact that the investigation against the petitioners, has already been completed, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Ghosi P.S. Case No. 142 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Jehanabad. (Hemant Kumar Srivastava, J) A.K.V./- U T
