.... Opposite Party/s ====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 16-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 366A, 504 and 34 of the Indian Penal Code. Allegation against the petitioner is that he along with other accused persons kidnapped daughter of the informant. It has been submitted on behalf of the petitioner that he is in custody since 17.1.2016. Chargesheet has been submitted against the petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioner. There was love affair between son of the petitioner and the victim and for the said reason petitioner has been made accused in the present case.

The medical examination report does not support the allegation made in the 164 Cr. P.C. statement of the victim. There is no eye witness to support the case of abduction of the victim as alleged in the statement of the victim. Recovery of the victim has also not been explained in the case diary.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Chief Judicial Magistrate-14, Motihari, in connection with Sangrampur P.S. Case no. 153 of 2015.
