Mr. Anish Chandra, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-07-2026 Heard learned counsel appearing on behalf of the petitioners and learned APP appearing on behalf of the State.

2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 406, 420, 467, 468 and 471 of the Indian Penal Code.

As per prosecution case, informant alleged that all these accused petitioners fraudulently obtained his signature on a blank paper, prepared forged affidavit showing that he had relinquished his share in the ancestral property and on the strength of the forged documents, illegally sold different

Patna High Court CR. MISC. No.43580 of 2026(2) dt.07-07-2026 2/3 portions of the ancestral land to third parties and thus, these accused petitioners misappropriated informant's share in ancestral property.

4. It is submitted by learned counsel appearing on behalf of the petitioners that petitioners are quite innocent and have committed no offence. Petitioner No. 1 is sister-in-law, Petitioner Nos. 2 and 3 are unmarried brothers and Petitioner No. 4 is married brother of the informant. The dispute arises out of partition of ancestral property between the parties which is purely civil in nature and for which, informant has got alternative remedies. None of the acts, allegedly committed by these petitioners, would give rise to any criminal liability. Petitioners claim clean antecedents.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioners.

6. Considering the facts and circumstances of the case, relationship between the parties, nature of accusation and clean antecedents of the petitioners, the prayer for grant of anticipatory bail to the petitioners is allowed.

7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named

Case No. 466 of 2025, subject to condition as laid down under Section 482(2) of the B.N.S.S..
