The petitioners seek bail in connection with Taraiya P.S. Case No. 116 of 2015 registered under Sections 147, 149, 341, 323, 302 and 504 of the Indian Penal Code. It is submitted by the learned counsel for the petitioners that though in the First Information Report the informant has alleged that altogether six accused persons including three petitioners of the present case indiscriminately assaulted with lathi upon the father of the informant, namely, Ashok Sah, the post-mortem report would reflect that the deceased had sustained only one head injury on his person which

Patna High Court Cr.Misc. No.35330 of 2016 (2) dt.22-08-2016 2/2 was caused by hard and blunt substance. It is also submitted that the two other co-accused, namely, Bachcha Sah and Bikau Sah having identical allegations to that of the petitioners have already been granted bail vide order dated 05.02.2016 passed in Cr.Misc. No. 51006 of 2015 by a Bench of this Court, as contained in Annexure-2.

Regard being had to the facts and circumstances of the case, the petitioners, namely, Dhanjeet Sah, Manjeet Sah and Tuntun Sah @ Tuntun Kumar Sah are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Taraiya P.S.
