JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 17-05-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody since 27.07.2016 in connection with S.T. No. 181 of 2017, arising out of Khajekala P.S. case no. 71 of 2011 for the offence under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act. Mr. Pramod Kumar Singh, learned counsel for the petitioner submits that the allegation against one Mulkan Rai @ Bulkan Yadav and this petitioner is similar as per the F.I.R. He further submits that Mulkan Rai @ Bulkan Yadav has already been granted bail vide order dated 21.02.2018 in Cr. Misc. No. 1247 of 2018.

Considering the above, the petitioner, whose case stands on similar footing, deserves similar treatment. Accordingly,

Patna High Court Cr.Misc. No.22604 of 2018 (4) dt.17-05-2018 2/2 the Court is inclined to grant bail to the petitioner. Let the petitioner, named above, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten thousand) with two sureties of the amount each to the satisfaction of Additional District & Sessions Judge-VI, Patna City, Patna in connection with S.T. No. 181 of 2017, arising out of Khajekala P.S. case no. 71 of 2011 with the condition that the bailors should be the family members of the petitioner.
