2. The petitioner seeks regular bail in connection with Gardanibagh P.S. Case No. 31 of 2026 registered for offences under Sections 21, 22(b), 25 and 29 of the NDPS Act.

3. The prosecution case, in brief, is that on 09.01.2026 at about 19:35 hrs, two persons allegedly fled away on seeing the police near Yogiya Tola, Yarpur, after throwing a red bag. They were subsequently identified as the petitioner Vikash Kumar and co-accused Ujjwal Kumar. On search of the said bag, 93 small packets of smack (about 55 grams including packaging material) and 6 vials of Avil injection (10 ml each) were allegedly recovered.

4. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.40537 of 2026(2) dt.23-06-2026 2/2 petitioner is innocent and has falsely been implicated in this case. It is further submitted that the petitioner is in custody since 26.03.2026 and is entitled to bail.

5. Per contra, learned Additional Public Prosecutor for the State opposes the prayer for bail and submits that the allegation against the petitioner is serious in nature and there exists prima facie material indicating his involvement in the alleged offence.

6. Having heard the parties and considering the nature and gravity of the allegation, this Court is not inclined to grant regular bail to the petitioner.

7. Accordingly, the application for grant of regular bail is dismissed.

8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner.
