JUSTICE SUDHIR SINGH ORAL ORDER 21-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 467, 468, 471, 420, 384 and 120(B)/34 of the Indian Penal Code.

It is alleged by the informant that accused persons in a criminal conspiracy got a forged sale-deed executed with regard to the land of the informant from one Rameshwar Kumar on 5.8.2014, vide sale deed no. 877962 and for the same land of the informant, the accused also got another sale deed executed from one Rudranath Mukherjee and since then they are trying to take possession over his land and house.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is said to

Patna High Court Cr.Misc. No.25204 of 2015 (3) dt.21-09-2015 have executed a sale deed on the basis of power of attorney given to him by one Rudranath Mukherjee. It is further pointed out that the said Rundranath Mukherjee has filed Title Suit no. 154 of 1990 against the informant in respect to the land, in question. The matter relates to civil in nature.

On behalf of the State and the informant, it has been submitted that the petitioner is named in theFIR. Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Muzaffarpur in connection with Muzaffarpur Town P.S.Case no. 847 of 2014, subject to the conditions as laid down u/s 438(2) Cr.P.C.
