The case was instituted under Section 156(3) Cr.P.C. The allegations were made directly as if it was a murder committed intentionally. However, the learned counsel has referred to the Court paragraph no.8 of the case diary which contained the statement of the son of the deceased and that statement indicates as if while driving back home, the deceased had dashed his motorcycle against a bridge and sustained injuries which ultimately proved fatal.
Patna High Court Cr.Misc. No.48839 of 2014 (3) dt.02-07-2015 Considering the material facts collected by the police during investigation, let the above named petitioners be released on bail in the event of their arrest by the police or surrender before the court below on execution of a bond of Rs.5,000/-(five thousand) each with two sureties of the like amount each to the satisfaction of CJM, Jamui in connection with Khaira P.S.Case No.79 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
