JUSTICE SUDHIR SINGH ORAL ORDER 09-08-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 365, 368 and 34 of the Indian Penal Code. Allegation is that informant's son has been kidnapped by some persons and petitioner is involved in the case during investigation.

It has been submitted on behalf of the petitioner that he is in custody since 15.2.2016. Chargesheet has been submitted against the petitioner. He has got no criminal antecedent. Petitioner is not named in the F.I.R. The victim has been examined under Section 164 Cr. P.C. and he has not named this petitioner. Petitioner has been made accused due to mistake of fact.

On behalf of the State and informant, it is submitted that name of the petitioner has come in course of investigation. Considering the aforesaid facts and circumstances, , let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the
