The petitioner seeks bail in Gautam Budha Nagar P.S. case No. 47 of 2016 under Section 395/397 of the Indian Penal Code.
The informant, Branch Manager of Dindayal branch of Punjab National Bank, alleged that some criminals came on motor cycle and committed dacoity in the bank. The dacoits also injured bank employees.
The learned counsel for the petitioner submits that petitioner is not named in the FIR. Name of the petitioner surfaced in the case in the confessional statement of Moidul Haque. The
Patna High Court Cr.Misc. No.12509 of 2017 (3) dt.13-04-2017 2/2 petitioner and Guddu Singh were arrested but they have not been put in T. I. parade as yet. The petitioner is in jail since 30.03.2016 and nothing has been recovered from his possession. Similarly situated accused Guddu Singh has been enlarged on bail vide order passed in Cr. Misc. No. 4413 of 2017.
Considering the facts that save and except confession of the co-accused the police did not collect any other tangible material not put the petitioner on T.I. parade, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in Gautam Budha Nagar P.S. Case No. 47 of 2016.
