The present application has been filed for prayer of anticipatory bail in a case registered for the offences punishable under Sections 341, 323, 504, 379, 506/34 of the Indian Penal Code.

The petitioners were granted anticipatory bail by learned Sessions Judge vide order dated 17.09.2014 passed in A.B.P. No. 1942 of 2014, but the petitioners could not surrender to execute bail bond within the stipulated period of six weeks. Subsequently, the petitioner filed an application before the learned Sessions Judge for extending the period of surrender. The same was rejected vide order dated 12.02.2015 vide Cr. Misc. No. 33 of 2015.

In the circumstances, the present application for

Patna High Court Cr.Misc. No.17492 of 2015 (2) dt.15-05-2015 anticipatory bail is not maintainable. Since the petitioner has been granted anticipatory bail on merits by learned Sessions Judge, let the learned court below consider the prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Bikramganj P.S. Case No. 84 of 2014, pending in the court of learned Sub-Divisional Judicial Magistrate, Bikramganj. It is expected that learned court below will dispose of the application for regular bail preferably on the same day.

With the above observation this application is disposed of.
