JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-05-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Barsoi Police Station Case No. 170 of 2014 registered for the offences punishable under Section 498A of the Indian Penal Code and 3⁄4 of the D.P.Act.
Petitioner happens to be husband of the informant and admittedly, petitioner solemnized his second marriage with informant after death of his first wife. Moreover, petitioner has already filed divorced suit against the informant. This court had issued notice to the informant but in spite of service of notice, the informant did not choose to appear before this Court.
Patna High Court Cr.Misc. No.11035 of 2015 (3) dt.18-05-2015 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st class, Katihar, in Barsoi Police Station Case No. 170 of 2014 , subject to condition as laid down under Section 438(2) of the Cr.P.C.
