JUSTICE PURNENDU SINGH ORAL JUDGMENT Date : 05-09-2023 Heard Mr. Raj Kumar Mishra, learned counsel appearing on behalf of the petitioner and Mr. Kumar Alok, learned SC-7 appearing on behalf of the State.

Learned counsel appearing on behalf of the petitioner submitted that substantial amount of retiral dues relating to the deceased employee, namely, Late Gulab Kumar Singh, who had died in harness while he was posted as Panchayat Secretary on 17.01.2019 has been paid and seeks to file a detailed representation before the District Magistrate-cum-Collector, Darbhanga, for grant of benefit of arrears of pension from 17.01.2019 to 31.03.2021 and

Patna High Court CWJC No.9932 of 2023 dt.05-09-2023 2/2 revised pension after giving benefit of time bound promotion including ACP and MACP to the deceased employee.

Considering the limited relief(s) sought for in the present writ petition, the District Magistrate-cum-Collector, Darbhanga, is directed to call for the service records relating to the husband of the petitioner (deceased employee) from Kusheswar Asthan Block. The concerned Block Development Officer is directed to personally produce all the service records relating to the husband of the petitioner (deceased employee) before the District Magistratecum-Collector, Darbhanga within a period of one week from the date of passing of this order.

4. The District Magistrate-cum-Collector, Darbhanga, is directed to make final payment to the petitioner in accordance with law within a period of four weeks from the date of filing of the representation.

5. With above observation and direction, the present writ petition is disposed of.
