JUSTICE SANJAY PRIYA ORAL ORDER 28-03-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Barachatti P.S. Case No. 128 of 2016 instituted for the offence under Section 366/34 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that it is a case of love affairs. The victim has already been married. In the written report, it is alleged that Indu Kumari daughter of informant had gone to market for purchase of vegetables and did not return. The informant got information that she has been kidnapped by this petitioner for the purpose of marriage.
The victim girl has been recovered and her statement under section 164 Cr.P.C. was recorded wherein she has stated her
Patna High Court Cr.Misc. No.8148 of 2017 (3) dt.28-03-2017 2/2 age 20 years. She has further stated that one Arvind Kumar was married with the friend of this victim and he gave her mobile number to this petitioner. The petitioner talked on telephone and thereafter took her to Punjab forcibly and kept her there for ten days and she returned with this petitioner.
From the narration made in the statement under section 164 Cr.P.C., it appears that it is a matter of love affairs The petitioner is in custody since 27.4.2016. Considering the aforesaid facts and circumstances, the prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Sherghati, in connection with Barachatti P.S. Case No. 128 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
