The petitioner is languishing in custody in a case registered for the offences punishable under Sections 302, 120B, 34 of the Indian Penal Code. As per the prosecution case, the informant alleged that on 24.07.2022, Bulbul Yadav and Ranvir Singh threatened her son, namely Pranav Prince (deceased) to kill him and on the same day, at about 12:00 a.m, co-accused Rupesh Kumar and Sanjiv Sada called her son from the house and on the next day,

Patna High Court CR. MISC. No.43891 of 2023(3) dt.23-08-2023 2/3 villagers informed that her son was lying dead near a river.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. For the alleged occurrence of 24.07.2022, the F.I.R was registered on 27.07.2022 without explaining the delay. There is no eye witness to the occurrence. The petitioner was not apprehended from the spot. During investigation, no consistent material evidence has been collected against the petitioner to connect the petitioner with the present offence. The petitioner is no way connected with the murder of the son of the informant and only on the basis of suspicion the petitioner has been roped in the present case. The petitioner is languishing in custody since 24.03.2023. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Moreover, other similarly situated co-accused has been granted bail by a coordinate Bench of this Court vide

Considering the fact aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, IV, Begusarai in connection with Sahepur Kamal P.S. Case No. 207 of 2022.
