2. The petitioner is in custody in connection with Ara Muffasil P.S. Case No. 66 of 2025 registered for the offence punishable under Section 190, 191(2), 126(2), 115(2), 109, 118(2), 352, 351(2) of the B.N.S.

3. As per the F.I.R, the son of the informant was in the field for purchasing tomato. Meanwhile all the F.I.R. named accused persons along with the petitioner attacked upon the son of the informant with lathi, danda due to which he sustained injury.

4. Learned counsel for the petitioner submits that the allegation is general and omnibus in nature against all the accused persons and no specific overt act has been alleged against the petitioner. A counter case has been filed by the side of the petitioner against the informant and others bearing Ara Muffasil P.S. Case No. 67 of 2025. It is further submitted that co-accused has already granted anticipatory bail in Cr. Misc. No.

Patna High Court CR. MISC. No.40505 of 2025(3) dt.20-08-2025 2/2 40247 of 2025. Petitioner has got no criminal antecedent and his is in custody since 15.03.2025.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

Regard being had to the submission made by the parties, taking into consideration the fact that there is general and omnibus allegation against the petitioner, specific allegation of murder is against the other co-accused and case and counter case is there between the parties. Further, the co-accused has already granted anticipatory bail in Cr. Misc. No. 40247 of 2025. Petitioner has got no criminal antecedent. Accordingly, I am inclined to grant regular bail to the petitioner.

7. Let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhojpur, Ara, in connection with Ara Muffasil P.S. Case No. 66 of 2025, subject to the condition that bail bond shall be submitted after commitment of this case. (Ramesh Chand Malviya, J) Mayank/- U T
