The petitioner seeks bail in a case registered for offences punishable under Sections 273, 272 and 290 of the Indian Penal Code and Section 47A of the Bihar Excise (Amended) Act, 2016. As per allegation 5 liters country-made liquor and one big and one small pot etc. were recovered from the house of the petitioner.

It is contended that the petitioner is a lady and she is having 8 months old child in her lap and the alleged articles which have been recovered, such as one big and small pot, are general house hold articles, thus, it cannot be inferred that the same was

Patna High Court Cr.Misc. No.26609 of 2016 (2) dt.14-07-2016 2/2 kept for preparation of illicit liquor. It is further contended that petitioner is having clean antecedent.

Considering the aforesaid facts and circumstances of the case, and the fact that the petitioner, Pinki Devi, is a lady with 8 months old child in her lap, she is directed to be released on bail on her furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate 4, Biharsharif, Nalanda in Rajgir P.S. Case No. 103/2016.

If the petitioner, after her release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of her bail bonds.
