The petitioner seeks bail in connection with Rail (Muzaffarpur) P.S. Case No.17/17 registered under Sections 341, 323, 354, 504 of the Indian Penal Code and Sections 8 and 10 of the POCSO Act.
The accusation is that in course of traveling in the train of the informant, Manoj Gupta, along with his wife Chhavi Gupta and two daughters this petitioner started to flirt by touching his daughters upon which his wife made protest, then the petitioner pushed the informant's wife and abused upon which the informant also made protest and the passengers of the bogy
Patna High Court Cr.Misc. No.14263 of 2017 (2) dt.08-04-2017 pacified the matter. When the informant along with his family members got down from the train at Muzaffarpur Railway Station then this petitioner started to assault to informant and his family members through belt but the passengers of the train caught hold of the petitioner and handed him over to the G.R.P. Learned counsel for the petitioner submits that, in fact,dispute in between the petitioner and the informant arose due to some hot talk exchanged for sitting in the general bogy. The petitioner having no criminal antecedent, is in custody since 14.02.2017.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Railway Judicial Magistrate, Rail Muzaffarpur, in connection with Rail (Muzaffarpur) P.S.Case No.17/17.
