JUSTICE SUDHIR SINGH ORAL ORDER 09-08-2016 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted under Sections 147, 148, 149, 504, 323, 337, 436, 353, 379 and 511 of the Indian Penal Code.

Allegation is that during Panchayat Election of Kulna Gram Panchayat at booth nos 200 and 199 brick batting took place in which some police personnel got injured and on chase by the police, the petitioners could be apprehended and others succeeded in fleeing away.

It has been submitted on behalf of the petitioners that they are in custody since 12.5.2016. Chargesheet has been submitted against the petitioners. Petitioners have got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioners. The case has been instituted due to political

Patna High Court Cr.Misc. No.25513 of 2016 (4) dt.09-08-2016 2/2 rivalry. The occurrence had taken place on the date of election. No specific act has been alleged against the petitioner. General and omnibus allegation has been made against the petitioners. On behalf of the State and informant, it is submitted that petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Nawadah, in connection with Akbarpur P.S. Case no. 75 of 2016.
