JUSTICE SUDHIR SINGH ORAL ORDER 14-07-2015 Heard learned counsel for the petitioner learned APP. The petitioner apprehends his arrest in a case registered under Section 20 of the NDPS Act.
As per the first information report, the allegation against the petitioner is that on search by the raiding police party, 95 packet of ganja containing 1 kg. in each packet, was recovered from the dickey of his car which he was driving. It has been submitted on behalf of the petitioners that the main allegation is against Navin Kumar Jha from whose possession a contraband article is said to have been recovered and that as far as the petitioners are concerned, there is no such recovery of contraband article from the possession of the petitioners. It is also submitted that other co-accused has been granted bail vice Cr.Misc.No.8711 of 2015.
On behalf of the State, it has been submitted that the petitioner is named in the first information report. Considering the aforesaid facts, the petitioner, named above, in the event of his arrest/surrender before the court below
Patna High Court Cr.Misc. No.24396 of 2015 (2) dt.14-07-2015 2/2 within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Jamui in connection with N.D.P.S.Case No.01 of 2013 arising out of Chakai P.S.Case No.78 of 2013, subject to conditions as laid down under section 438(2) of the Cr.P.C.
