JUSTICE SANJAY PRIYA ORAL ORDER 02-03-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Muffasil P.S. Case No. 234 of 2016 instituted for the offence under Section 25(1-b)a, 26, 35 of the Arms Act and Section 53 (b) of Bihar Excise Act, 2016. It has been submitted that the petitioner is in custody since 8.6.2016. The trial has not begun in the Trial Court. From the allegation, it appears that one country made pistol loaded with one live cartridge was recovered from the possession of the petitioner.

Keeping in view the period spent by the petitioner in custody and the trial has not begun till date, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released

Patna High Court Cr.Misc. No.7903 of 2017 (2) dt.02-03-2017 2/2 on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Muffasil P.S. Case No. 234 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner. The petitioner in any manner will not try to hamper the trial by intimidating or influencing the witnesses and will remain present on each and every date of trial. Any two subsequent defaults will result in cancellation of bail bonds in the court below.
