JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 25-07-2016 This application has been placed today under the heading "To Be Mentioned" for modification of the order dated 12.07.2016 passed in Cr. Misc. No. 27691 of 2016 pending in the Court of Judicial Magistrate, 1st Class, Gopalganj in connection with Barauli P.S. Case No. 66 of 2005. Submission of learned counsel for the petitioner is that in the prayer portion of the petition, inadvertently, the words "Additional Sessions Judge-II" had wrongly been typed in place of "Sri Vivek Singh, Judicial Magistrate, 1st Class." Due to that reason in the order dated 12.07.2016 passed in Cr. Misc. No. 27691 of 2016 in the last paragraph Addl. Sessions Judge-II, Gopalganj has been typed. Further also in the 2nd Paragraph of the order dated 12.07.2016, Section "304"

Patna High Court Cr.Misc. No.29896 of 2016 (2) dt.25-07-2016 2/2 inadvertently has been typed in place of Section "304B". In view of the above submission, the modification application is allowed. In the last paragraph of the order dated 12.07.2016 passed in Cr. Misc. No. 27691 of 2016, let the words "Additional Sessions Judge-II" be corrected to be read as "Sri Vivek Kumar Singh, Judicial Magistrate, 1st Class" and also in the 2nd Paragraph, Section "304" be read as Section "304B".

Accordingly, the order dated 12.07.2016 passed in Cr. Misc. No. 27691 of 2016 is modified to the extent above. (Rajendra Kumar Mishra, J) Shail/- U T
