Petitioner, already in custody, seeks bail in connection with Khijarsaray PS Case No.137 of 2016 registered under Section 304(B) of the Indian Penal Code as well as under Sections 3⁄4 of the Dowry Prohibition Act.

Allegation in brief is that on 29.06.2016, the informant received telephonic information that his sister has sustained burn injuries and the petitioner informed that the they went to Gaya hospital for treatment wherefrom referred to Patna. The informant alleges that he came to Patna and his sister disclosed that due to non-fulfillment of demand of dowry, she was burnt by the accused persons.

Learned counsel for the petitioner submits that though

No.21474 of 2018(6) dt.26-06-2018 2/2 the petitioner is the husband but it is a case of accidental fire and he informed his in-laws with regard to the accident and brought his wife immediately for treatment first to Gaya and then to Patna. It is further submitted that this case was instituted after four days of the alleged occurrence. There is no statement of the wife before the police or before the medical officer. Having considered the aforesaid facts and circumstances, petitioner Vikash Kumar @ Vikash Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-VII, Gaya in connection with Khijarsaray P.S. Case No.137 of 2016 with condition that petitioner shall remain physically present on each and every date before the trial court and if he absents himself on two consecutive dates without any reasonable cause, his bail bond shall liable to be cancelled.
