JUSTICE ASHWANI KUMAR SINGH ORAL JUDGMENT Date: 18-09-2015 The present application under Section 482 of the Code of Criminal Procedure (for short 'Cr.P.C.') has been filed for quashing the order dated 12.3.2015 passed in Cr. Revision No. 18 of 2013 by the learned Additional Sessions Judge, 1st Lakhisarai whereby the revision application filed by the petitioner and others against the order dated 17.11.2012 passed in Cr. Misc. No. 717M of 2012 by the learned Sub-Divisional Executive Magistrate, Lakhisarai in a proceeding under Section 145 Cr.P.C., has been dismissed.

Though the present application has been filed under Section 482 Cr.P.C., the same is in the nature of second revision

Patna High Court Cr.Misc. No.25352 of 2015 dt.18-09-2015 2/2 which is barred under Section 397(3) Cr.P.C.. Even otherwise, I do not find any patent illegality in the impugned order passed by the revisional Court.

In that view of the matter, the application being devoid of any merit, is, accordingly, dismissed.
