The petitioner seeks bail in connection with Riga P.S. Case No. 255 of 2013 registered under Sections 304-B, 201/34 of the Indian Penal Code.
The accusation against the petitioner is of killing the daughter of the informant due to non-fulfillment of demand of she-buffalo and a golden chain by her parents. The learned counsel appearing on behalf of the petitioner submits that in fact deceased, who was the wife of the petitioner, consumed poison due to scold made by her in-laws in absence of the petitioner as he was in Punjab to earn his livelihood. Patna High Court Cr.Misc. No.11226 of 2017 (2) dt.17-03-2016 the petitioner while submitted chargesheet against the in-laws under Section 306 and 201 I.P.C. Differing with the opinion of investigating officer, the learned C.J.M. took cognizance under Section 304-B and 201 IPC against the petitioner and his parents. Petitioner is in custody since 14.12.2016.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sitamarhi in connection with Riga P.S. Case No. 255 of 2013.
