ANJANA MISHRA ORAL ORDER 02-05-2018 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are in custody since 06.12.2017 in connection with Riga P.S. Case No.89 of 2017 registered for the offence under Sections 363 and 366A/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that these two petitioners have no role to play in the alleged kidnapping of the victim girl. It is further submitted that the brother of the petitioners, namely, Shiv Bachan Pandit, has allegedly married the victim girl and they got married at Delhi and when she became pregnant, they came at Sitamarhi and during the course of treatment of pregnancy, she died.

No.20807 of 2018 (3) dt.02-05-2018 2/2 Learned counsel for the petitioner, however, submits that similarly situated co-accused persons, namely, Shanti Devi and Shail Devi @ Kanti Devi, have since been extended the privilege of anticipatory bail in Cr.Misc. No.8073 of 2018, vide order dated 22.03.2018.

In view of the aforementioned facts and circumstances of the case and that the petitioners have no criminal antecedents, let both the petitioners, above named, be released on bail on their furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Sitamarhi, in connection with Riga P.S.
